MEMPHIS, TN (WMC) - As a Memphis family is trying to come to terms with the loss of a 6-year-old boy with a promising future, the man accused of hitting the child with his car is dodging bullets.

The family of 6-year-old CJ Smith wants to know why the man who hit and killed him has not had upgraded charges. Police said new charges could come soon.

Christoper "CJ" Smith's family was hit and killed on his way home from school last Monday. The man who hit him, 35-year-old Arthur Christopher, is currently only charged with driving without a license and insurance.

Carpenter's home was riddled with bullets twice on Monday, once at 5 p.m. and the other around midnight near the same back door of the home.

Memphis Police Department said they are currently looking for two black men in a gold Maxima.

Smith's family is calling for the community to come together and put the children first. They said that can be done by bringing light to what happened to CJ. The family said Smith fulfilled his purpose on Earth and is now saving lives by donating his organs and reminding people to watch for children.
