Officers in portable toilet tipping incident previously cleared of 'deadly force'

(WMC) - Internal investigations continue into the Memphis police officers caught on camera, tipping over a portable toilet with a suspect inside.

"I could hear them when they pulled up, so I knew that they were behind the porta potty," Jo Hampton said. "I heard them say on three. Three. And it went over ... I believe they tried to humiliate me."

Memphis Police Department internal affairs records show three of the four officers involved have previously been cleared in internal affairs investigations for the use off deadly force.

On April 10, 2013 on Interstate 40 and Sycamore View Road, officer Manuel Saldana shot and killed Daniel Brock, whom police say threatened to kill three other people during an odd road rage incident.

Multiple witnesses told investigators they did not see Brock with a weapon, "just his fists."

But those same witnesses also emphatically told police they feared he might kill them too.

Saldana told investigators, "I was in fear for my life. We had direct eye contact, and as he was snarling and growling, he pounded on his chest with his left hand, but I could not see that right hand."

On August 30, 2013, Saldana received a letter from MPD declaring his use of deadly force "justified."

Officers Timothy Taylor, Taylor Ackerman, and Roosevelt Shaw have all had their use of deadly force"justified" too, after each shot pit bulls during their time of the force

Shaw and Saldana were both cleared in civilian complaints about alleged searches without consent, and Ackerman was cleared in a civilian complaint about the alleged use of excessive force.

MPD says no official complaint has been filed with internal affairs about this toilet incident, but the administration has opened its own investigation.

The four officers remain on paid leave pending the outcome of that administrative investigation. They could face possible suspension or if the charges are found to be not sustained, nothing will happen to them.
