Judge sides with prosecution, allowing search warrant results be presented at Tim Herrington trial
RIPLEY, Miss. (WMC) - Discussions are underway at the Tippah County Courthouse ahead of the capital murder trial against Timothy Herrington.
He’s accused of killing University of Mississippi student Jimmie “Jay” Lee.
Lee went missing in July of 2022 and is now presumed dead.
The trial doesn’t start until December 2, but Monday in court, the defense filed a motion arguing to withhold evidence from being presented at trial.
In this case, it’s the results of multiple search warrants conducted by the Oxford Police Department, including through Herrington’s apartment and his phone.
The judge has sided with the prosecutors, saying there was probable cause for Oxford police to issue search warrants for Herrington.
Another question that was raised in court was about Herrington not being read his Miranda Rights while he was being arrested.
The judge will make a decision on that Tuesday.
